I greatly appreciate that you would help me identify this I-485 filing timing issues. Thanks many many thanks for your kind helps in advance.
Currently, I have a timing issue regarding my girl friend's I-485 filing timing issue. The detailed information is as follows:
I submitted my I-140 (EB-1) and I-485 concurrently on March 2005. On
April, 2005, my I-140 (Eb-1) was approved and I got the notice of
approval on May 2005. Currently, my I-485 is still pending in Vermont USCIS.
In June 2005, I married her and I try to help her to file the
I-485 for her as my spouse. My questions are as follows:
1) If I filed for her I-485 as my spouse, do you think she will be
qualified for I-485 filing even our marriage date was later than my
I-140 approval date but still during my I-485 pending period (before my I-485 approval date)?
2) If she is qualified to file I-485 as my spouse, is she qualified
for apply the EAD I-765 and AP while her I-485 is pending?
3) What the difference for my wife's I-485 application between the
following senarios: 1) if I were a Green Card hoder; 2) If I am still
waiting for the I-485 (my I-485 is pending) ?
