各位老师好,
我今年想自己房子修建一道fence,给两侧邻居打了招呼,也从hoa拿了批准。结果遇到了一个特别多市的邻居,找各种理由不想让我修建,最后他找到起初修建房子的secondary plat,里面有covenant,conditions and restrictions,有一条关于patio easement and patio fences的规定,说实话真心不适合我的情况,因为我向我的城市求证过我的房子是single family house,和这个patio fence没有任何关系。我的只是建立一个fence,而且也遵循了所有关于covenant中fence的规定。
我有两个问题想请教,
1,secondary plat是1992年的存档,但是hoa的网站上有一个2009年修订过的CC&P,这个情况下是不是应该按照新的CC&P来执行?
2,邻居把我和物业一起告了,现在让我停工,我是不是现在必须就停工了?还是现在的只是一个notice?原文是:
COMES NOW,Plaintiff,xxx,Pro se, having filed its Verified Complaint for Injunctive Relief and Attorneys' Fees, and moves the court to issue a preliminary Injunction prohibiting Defendants, xxx HOA and me from violating the covenants by allowing me to erect a fence in the Patio Area of his property...
WHEREFORE,Plaintiff requests that this Court set this matter and Motion for a hearing for the issuance of a Preliminary Injunction, estimated in good faith to take approximately one hour and for all other proper relief in the premise.
