Here is my situation:
My H1-B (working in university) and my wife's H4 will expire at the end of this year. Now I have to extend my H1B. I know it is late, but HR told me that I will be OK if I can get the receipt in time. And BTW, I have valid EAD , my wife has valid AP, I-140 was approved and I-485 pending)
But my wife went back to China a month ago and will NOT be back until next March. I guess that I cannot include her in my extension application in U.S. and she has to go consulate process to apply H-4 visa, am I right??
My question is: Can my wife just using her valid AP document to enter US and apply H-4 later when she is back in U.S.?
