i am currently holding an H1b at a university and have also applied an O1 for my future job at a company. My O1 got approved with a starting date of 07/10 (my lawyer put this date on without my consent :( ), but my actual starting date at the future company is 08/01. Now I have a big headache what my status is.
The OIS of my university says: as long as my O1 is approved, I am in O1 status and out of h1b and can't work at the university any more.
My lawyer says: My H1b doesn't terminate automatically with the approval of my O1. I can still work at my university. My O1 status will start when my new company report to USCIS when I start working.
Both sound reasonable, now I don't know who to listen to. Do i have a problem of being out of status?
