I GOT MY EAD NOW. I FIND A JOB BUT I DON'T KNOW WHAT I AM SUPPOSED TO DO. I WORKED FOR A WALL ST. FIRM FOR TWO YEARS AND GOT H1-B VISA, WHICH IS THE EXPIRATION DATE IN 2008. I LOST MY JOB IN EARLY 2006. UNFORTUNATELY,I DIDN'T CHANGE MY STATUS TO H-4 RIGHT AWAY BECAUSE I DID NOT UNDERSTAND THE IMMIGRATION LAW. I DID NOT REALIZE THAT I GOT A BIG TROUBLE UNTIL OUR EB1a I-140 WAS APPOVED IN MARCH 2006.

I FOUND AN AMERICAN ATTANEY SINCE VISA BALLETIN WAS CURRENT FOR EB1a IN JULY, WE ED OUR I-485 IN JULY 2006. LATER, WE DID FP AND GOT I-797 AND EAD. I AM SO SORRY ABOUT "THE GAP" BETWEEN MY "H1-B VISA" AND THE NEW "EAD". I HAVE NOT BEEN DOING ANYTHING SO FAR REGARDING THE GAP. MY ATTANEY SUGGESTED LETTING IT BE. KEEP MY FINGERS CROSSED SINCE I AM NOT A PRIMARY GC APPLICANT.

IN FACT, I HAVE FOUND A POSITION IN CHINA JUST IN CASE USCIS ASKING FOR A I-485 INTERVIEW BEFORE WE GET GC APPROVAL WITH GIVEN SITUATION. BUT MY ATTANEY STRONGLY SUGGESTED ME NOT TO USE MY I-797. IN OTHER WORD, I AM BETTER OFF NOT GOING BACK TO CHINA FOR A JOB.

CURRENTLY, I FIND A JOB WITH EAD IN NEW YORK. I WAS, HOWEVER, WANDERING IF THERE IS ANY BAD EFFECTIVE FOR OUR I-485 OR GC APPLICATION. PLEASE OFFERING YOUR SUGGESTIONS! I REALLY APPRECIATE YOUR TIME AND HELP!

you may use your EAD to work,it won't be problem to your I-485
