q1) My 485 is pending. My first three year H1b will expire Dec 2007. If i use AP in summer, can i still extend my H1b when i came back.

q2) I learn from here that I can still keep my H1B after i use AP if i stay in same institution. But my lawyer said. I will lose my H1b once i use AP. Could you clarify it?
