I use EAD, my son will be out of status, please help migc2007-04-10 21:52:22

Dear all,

My I-140 was approved on the basis of NIW. Currently, I hold H1 and my son has H4. My son also filed I-485 on 9/25/2005. There was a mistake for payment, and then it was rejected by immigration office. Due to the changes of immigration law at that specific time, i.e. if you have something wrong with your application, you were not allowed to re-file I-485, which means you have to wait for the availability of visa number(current 4/22/2005).

Now I get an offer from company and I must use my EAD. As some of you said, if I am going to use my EAD, my son will be out of status. So, what should I do? please advice!!!
