(a) Info about my NIW-EB2 case
***** Year 2005 *****
(1) NIW-EB2, Texas Service Center(TSC), 140/485 concurrently filed in early September, 2005
(2) 140 approved on October 18
(3) Finger Print(FP) on October 21, LUD updated
(4) 485 RFE October 25 for employment letter, W2 and pay stubs.
***** Year 2006 *****
(5) Responded to 485 RFE in early January, LUD updated and remained unchanged since then.
(6) Called TSC in September and told that security clearance pending.
(7) Called TSC in November and told that visa number not available. No calls to TSC since then.
***** Year 2007 *****
(8) Received FP notice from TSC for second FP (April 27) to be done on May 5th.
(b)Info about my labor certificate
(1) Just got information from my attorney that my RIR-LC has been certified from the backlog center.
(2) LC priority date January 15th, 2005 so the PD is current for this one.
(3) Need to pay additional $1500 attorney fee plus filing fee, medication examination fee to concurrently file 140/485.
My feeling/questions:
(1) My NIW case is pretty interesting. the time between RFE and 140 approval so short.
(2) I cannot decide whether to file the LC-based 140/485.
(3) Is that possible that I file the LC-based 140 ONLY and later relink my NIW-based 485 to this LC-based 140?
(4)Is the second FP a good sign that my name check has been cleared?
