I have a pending petition for adjusting my status from F-1 to F-2 (My hu*****and is currently holding F-1). Since my hu*****and's OPT will expire in August, he has to adjust to H-1 visa status. So I also have to adjust to H-4 status. My hu*****and's employer says that I must leave US before they our H-1 and H-4 petition. It is risky if I stay at US while they our petition for status adjustment. The risk is that if my petition is denied I was out of status from the day I ted my F-2 petition and I will never be allowed to enter US. Is that very risky that I H-4 petition while an F-2 petition pending? Thanks.
