我去年11月通过律师递交了NIW140, 我的案子被留在了NSC,pending now.今年七月我递交了I485 based on NIW 140.
今年五月的时候我DIY了EB1A, EFILE 到TSC. 十月初的时候被批准了.我读了很多这个板的帖子,准备在递交一份485. 但是因为我想用EAD和AP, 所以去了INFOPASS, 相去问一下是否还用申请新的EAD和AP. 在INFOPASS,an officer told me immediately that I don't need apply another 485. she said she can help me send a request to NSC to interlink my current 485 to my approved 140. Because my hu*****and was not with me at that moment, she can only start request from my I-140 cases. I did not see the letter she wrote though.
昨天我收到INS的来信, 说我在某天的REQUEST has been kept in my file. However the information listed is not very accurate. The letter basically shown that the request is from an I-140 petition (however the receipt no is my 485 no) to a I-485 petition (here is my LD's 485 No). I don't know what is going on. My guess is that they already received the request from INFOPASS. BTW, We have no LUD on any of my cases.
What should I do? Can I still refile another 485? Can I withdraw my pending NIW to see if our 485 are still valid? However we really want to use AP and EAD soon. Thanks a lot for your suggestions!
