The office of internal student and scholars (OISS) of our university helped me to consult an attorney on the matter of H1 status after using AP. The OISS told me that if you return to the US using AP, you must use the EAD to resume work as the H1b may be considered void after such an entry. Can you explain me more how much chance and how this situation will happen? Because according to your post “＂再谈 AP 和 EAD 对 F/H 身份之影”, no problem to keep H1 visa status after using AP if H1 is in valid period.
I plan to using AP to re-entry. I do not want to re-apply H1 VISA in China and do not want to lose H1 status after using AP. Please give me more advice.
