I graduated in May, 2007 and submitted petition of I-140/I-485 in Aug., 2008 individually and case of I-140 is still pending. I am using EAD to work.I didn't apply for H1-b. And my hu*****and is with H1-b visa and is not in my I-140/I-485 petition.
Unfortunately, I gave a birth of baby extremely prematurely and I plan to take a long time off the current job or quit the job to take care of the baby.
My questions is:
If I quit the job and don't get a new one due to this family crisis, what the impact will be for my I-140/I-485 petition? Is it valid? Is there any problem for me choose to not to work in the status of AOS?
If I change to H-4, what will it change for my I-140/I-485 petition?
Or, if try to apply for H1-b and get approved in 2009, will it invalid my I-485 petition and I need to come back to China to get Visa?
I don't know what the best strategy for me to balance between taking care of the baby and immigration , quite the job, change to H-4 and apply for H1-b or other way, thanks for any suggestion for my case.
