Filed Form 7001 to CIS Ombudsman on 11/8/2007
Wrote letter to another Senator on 11/8/2007 and received response on 11/16/2007 stating that they can not help with this.
Received a phone-call on 11/19/2007 afternoon from first senator’s office saying they did receive response from USCIS and my case is still pending for NAME CHECK with FBI and They will do a follow up, if in 90 days, I don’t receive any update, call them again and they will contact FBI (my goodness!!!).
Sent to FBI for FIOPA on 11/14/07 (dated 11/13/2007)
Received response from FBI on 12/03/2007. “No records responsive to your FOIPA were located by a search of the automated indices”.
Call NSC on 11/15/2007, No further information (including name check) is available, but got a referral number. The lady suggested that I contact FBI local office for help.
Wrote to FBI local office to seek for help in expediting name check on 11/15/2007
Received response from FBI local office on 11/28/2007. It says my FBI portion was completed on Nov. 26, 2007.
Called NSC again on 11/29/2007. No update information (shit).
Received response from CIS Ombudsman on 11/30/2007 saying it initiated a formal inquiry with USCIS. USCIS should issue a response to you within 45 days.
Received response from senator’s office on 12/14/2007 (dated 12/10/2007) stating my name check is pending for FBI completion. If no updates within 3 months, I should contact them again.
Received letter on Feb 1st, 2008, from USCIS in response to my inquiry on 11/15/07, saying the case is waiting for an officer to review.
On 2/8/2008 received letter from FBI saying they received letter forwarded from FL. My name check was received on June 1, 2005 and it was cleared on Nov. 26, 2007. This is consistent with local office’s response.
On 3/17/08 received letter from USCIS in response to my Omnibus inquiry saying that they can not process my case due to visa limitation and the visa issue is the duty of DOS not USCIS.

9/1/2008 received a letter from Senator’s office saying they had sent an inquiry to USCIS it takes 30-45 days to receive response
9/7/08 Received e-mail notice from USCIS stating my case is being reviewed and a decision will be made within 60 days unless other action is needed.
9/9/2008 I485 LUD again (no information change)

9/29/2009 I140(EB1b) approved
10/1/2009 Quota visa is available to my 485 associated with my first I140-NIW application
Wrote a letter on 10/6/2009 to USCIS requesting relink of my I485 to new I-140 (EB1b).
Called on 10/20/2009 and was able to talk to a visa officer, he asked me to write to do the relink. I said I wrote weeks ago. Then he said I need to wait for 60 days.
Wrote another letter to do the relink again to the address listed on I140 approval notice immediately
On 10/27/2007, received welcome notice through e-mail: my I148 has been approved.
On 10/28/2009: another e-mail: card ordered.
Got a lot of information from this forum.
Wish Good luck to everybody whose application is still pending for approval.
My suggestion: If you are pending for EB2, you should also try EB1 to expedite the process of your I485 approval.
