我母亲于去年8月拿到1年多次入境B2签证,去年10月第一次入境,今年3月回国.之后又于6月30号第二次入境, I-94到今年12月29过期.我姐11月5日公民面试通过,但要排到2010年1月28日宣誓.请问我应该给我母亲办延期呢, 还是让她out of status for just one month? I have the following concerns:
1)If I apply the B2 extention for her, most likely the application will get rejected, if the rejection letter is arrived before her I-94 expiration date, she will end up out-of-status anyway. My major concern is, if the extention request did get approved, then later on, when my sister apply for Green Card for my mom, is that possible that her Green Card application will get challenged or rejected on that part, i.e. the immigration officer will question her motivation of B2 extention.
2) If I leave the way it is, which means my mom will be out of status for at least one month. Can we still apply for Green Card for her later on? Is there any other risk associated with this "Out of Status"?
请大师们指教, what is the best way to handle this. My mom has been applied for B1/B2 visa for so many times in the past 10 years and it's her first time get the visa. I really don't want her to go back and apply for B2 visa again. I deeply appreciated all of your advice and help! Thanks!
