The kid filed his 1st 485 with her mom's EB2(pending). now if kid wants to get his green card based on his dad's approved 485( EB1a), which way is better, filing 2nd 485 or relink?
My lawyer wants to relink and asked us to fill out the Privacy Release Form to ask for Senator's help. but other lawyer said
"Your daughter currently has an I-485 that is pending with your PD. In order to link that I-485 application to your former spouse's PD, you could request the USCIS to interfile it with your former spouse's I-485. However, in reality, it may not be that simple to achieve it. You will have to make written requests and follow it up with phone calls, etc.
If you want to keep it simple, your daughter can refile her I-485, ensuring that she uses her A# and explain that it is her 2nd filing. At some point (preferably when one of her AOS application is being adjudicated), she will need to withdraw the other I-485 application.
Which way is better and faster. anybody has this exprience?
