As it was previously discussed in I-485 被拒与入境限制, 245(k) only addresses "身份违例不超过 180 天" but never mentions relief on "申请人当前身份必须合法", which is outlined in I-485 instructions 10 (d) of "who may file 485" section.

我知道，自从我去年11月14日非法打工起，我就OOS了。也就是authorized stay expired了。(Instructions for I-485，Who May File Form I-485? 10. D.)
