8老师，过了几日又有问题向您请教！请您给个建议。 新公司现在可以给我file to consolar, 不需要J waiver，但是我必须回国一次，等J waiver 下来，申请H 签证再入境。不知道这个再入境会不会有多余平均水平的额外风险。
还有一种选择是，等拿到J waiver（ 大概 要到9月20多号了，但现在还不确定，还要看中方是否如预计会在下月发我的NOL），之间file change of status。可是我拿了一个I20到明年2月，到时候在H1B processing过程中，我的身份会很复杂，不知道是否会影响到H1B申请结果。

以F1身份来美，今年OPT期间找到工作，并于5月取得H1B。7月换工作，新工作帮转H1B时发现之前有2009年有J1签证，并不满足2年回国要求，也无J豁免。新公司将无法申请H1B，直到J豁免批准。 已于7月初递交J豁免申请，目前在等待状态。今年10月1日H1B将激活生效，请问目前是否需要在H1B激活前将原有H1B withdraw？原公司还未withdraw。如果withdraw，是否仍然受限于每年的名额制？最晚什么时候withdraw？有什么方法可以保住名额，等到J1 豁免下来成功transfer？
-You need to go back to work for your old employer who sponsored your H-1 to activate the H-1 and keep your H-1 status (the H-1 approval is valid even if USCIS made an mistake to approve it). If your old employer withdraw this H-1, you will be out of status after Oct. 1 and you have to leave US. You can not do the H-1 transfer unless you get the J-1 waiver. I am curious why you did not get the J-1 waiver earlier.
