8老师，曾经请教过您关于status的问题。突然接到公司邮件，新公司file 的 H1B with consular notification 被要求Request for Further Evidence (RFE)。 之前通过的H1B 是一个错误，旧公司的律师做错了案子，申请时写了从来没有过J签证。请问已经通过的H1B 会不会被revoke？ 如果被Rovoke了，我就要立即出境？RFE会不会影响到新H1B 申请的通过？

今年拿到H1B名额，10/1日生效，后被解雇，但从未跟USCIS取消过H1B。OPT grace period期间转入新学校，现在是F1，到2014年2月截止。但I20上注明了10月1日H1B会生效。后找了新工作，新公司于9月file H1B petition with consular notification, 开始日期为12月2013。用了premium processing 服务，9月16日file，现在还未通过。请问8老师，10月1号以后我还能留在美国吗？是以什么身份停留？
-Your F-1 status will be invalid after October 1 due to the old H-1 activation, so your status will have a problem. Before your new H-1 is approved,, you can legally stay in US, but if your new H-1 is approved before November 22, 10 days before the new H-1 is effective, then your legal status will be a problem. So, you should have not used premium processing for the new H-1 petition.
My suggestion is that you may just wait for the new H-1 approval, then go to China to get the H-1 visa to come back in advance 10 days before the H-1 is effective in 12月2013 (e.g. if the H-1 is effective on Dec. 1, then you can come back in Nov. 22 or later).
8老师的意思是：在新的H1B通过前我可以有效合法停留。预计是15天会以内会得到USCIS的回复，那么是在10月1日原有H生效日左右。如果新的H通过后，我多停留10天至10月10日左右，这会不会影响回美国的签证？-No.
再有，我受至于J，豁免也没拿到，当时H通过时律师的一个错误，但是H通过了。这种情况，我原有H 是否会在10月1日生效？-Yes.
有什么方式可以让这个H不生效？
为了能顺利拿到豁免，我希望能多停留10天，等拿到NOL。请问8老师有什么好的建议？-Fine for you to stay for a few weeks even for a couple of months because your H-1 I-94 is still valid though you do not have a status.
