My wife H4 visa issue became our family nightmare due to our mistake. We really need your guys professional comment or share with us your experience if you have. We will highly appreciate your any feedback.
The case is as below.
1) My wife hold 3 month H4 visa to enter US, but US office only give her stay period base on Visa time, not my H1 period. At that time, my wife and I don't notice that until my 2nd H1 renewal and extend her H4 status. It is around one and half year expired.
2)My attorney notice this when he filed our H4/H1 renewal on 5/30/2002. But my H1 got approval on 1/15/03, and her H4 was denied on 1/15/2003.
3)We filed appeal to re-open on 2/14/2004, but it was denied on 9/23/2004, unfortunately, attorney informed us last week , it is about 5 months delay. We don't know it was delayed by INS or our attorney.
