I must make a tuff decision recently. I already got an internship offer from a famous company for next summer. In order to obtain the eligibility for internship, I am planning to change my visa status from H-4 to F-1. (I am a first-year graduate student right now.) However, considering my situation, I am wondering whether I should change my status. My case is: my hu*****and submitted Labor Certificate about 2 years ago. Though the current processing speed is very slow, it is still possible for him to get the result within a couple of months. If his LC gets approved later, I will be able to apply EAD card.
My questions are the following. Pl help me if you know any piece of information regarding my issue.
1. If I submit the application for status change (H-4 to F-1) now, can I submit another application for I/140 , I-485, and EAD at a later time before I receive the INS's decision on my status change(it takes 3-4 months in general)? Is there any policy that states I must wait until I receive the final decision on my first application, then I am able to submit the second one(different application)?
2. Is there any conflict between two applications? Will my application for status change to F-1 affect my future application for I/140,I-485 and EAD?
3. If both applications (F-1 and EAD) are approved, what status will I be? F-1 or something else?
4. What are the advantages and disadvantages for changing to F-1 and keeping H-4?
My case is really complex. I am weighing between changing and waiting for LC. XDJM, would you please give me any suggestion? Thanks a million!
