Experienced friens please clarify our confusion. My hu*****and was planning to apply GC through university by outstanding researcher, however, the university lawyer said the recent rule of INS is if your salary is based on the grant (such as non-tenure track research associate professor position), it is not considered as perminant job,therefore, we are thinking of apply ourself through NIW or extrordariny ability, my question is if extrordaniry ability must require employment based??? it is EB1a or EB1b?? NIW is EB1a or b? I thought EB stands for employment-based, We need to decide quickly, so please give some advice.Thanks a lot!
