I was laid off on 04/11, I submit an application for H4 on 04/20 to vermont. It has not been processed yet. I got 2 offers last week. and I took one job and started to apply new H1. The new job has their own immigration lawyer to do this. She is an American. Her openion is very different from my other old Chinese lawyers. As I have the paycheck of 04/28 (which showed 2 days and salary of 04/10 of 04/11), I asked her if we should submit this paycheck, I told her if we submit, officer in INS would know I got laid off on O4/11, there is a gap between 2 H1B. All other Chinese lawyers told me we should not metion this layoff fact in new H1B application, so make it look like H1 transfer. However, this American lawyer told me we need to tell INS that I am laid off on 04/11. She said the layoff is not my fault, and I found new job is a short time, she did not expect the gap between 2 jobs would be a problem. Does anyone know if this is the noraml practice to put "layoff" in the new ah1 petion?

As the company paid all all the cost (even for premium), even I am not sure how good this lawyer is, I can not ask them to change a lawyer. Also this lawyer said my H4 might not be withdrawed from the system and it will cause a problem. I do not get it, if I withdraw H4 when I file new H1, it will be withdrawed. How come will it not be withdrawed? I have to say I am not quite conviced that she is good. I hope I just worry too much.
