I was laid off on 04/11. I filed h4 on 04/19. Now H4 is still pending, under process.
My new h1b is filed under permiun process today. The lawyer said we should not add the request of withdraw H4 in this h1 application, We should wait until H1b is approved, then request h4 withdraw. so even my h1 does not go through, I still have status as h4 pending. But I heard it is difficult to withdraw h4, sometime it will be approved even you ask it to withdraw. Shall I just withdraw my H4 now, together with h1 application case?
I asked my old Chinese lawyer, he told me it has been one month after my last h1b (04/11), I can not just submit the h1 application, I have to wait the h4 is approved, then h1 will be processed? It is called "consolidate"? Is that true? As H4 still needs one more month to process. Do I need to wait that long? Even my hib use premium process. I can not get the result in 2 weeks?
