Sue FBI的方法如下：
1）Security check needs to have been pending for at least 6 months
2) before making the lawsuit, one needs to have a stack of inquiries which shows FBI has always been saying it's pending. One has better to have ~6 months of inqueries or at least 2 or 3 inquery response.
To make it clear, one needs to start inquery after it has been pending for 6 months. It takes up to 6 weeks for FBI or USCIS to respond. So one can inquery 2 or 3 times after the first 6 months. This (1 year) is reasonablely long for FBI security check wait.
Two ways to make inquery:
1) inquery USCIS every 2 months by yourself or through senator office
2) inquery FBI through senator office every 2 months
3) Writ of Mandamus
The lawsuit paper goes to the federal court in your district. Every kind of decent city should have such a court.
Usual results:
FBI asks you to withdraw the lawsuit because they don't want to make the effort, time, money or resource to show that how busy they are and how reasonable your case should wait. They want to dismiss the case off court. Of course, they will clear your case before you withdraw the lawsuit. This is not time consuming. Usually it takes up to 6 weeks from the beginning to the end.
In addition, it's risk-free. I told my lawyer that as a guy who came from mainland China, I know that if you sue the Chinese government, the government may make you pending for ever. She said it is very unlikely that the lawsuit would retard the case. Although it's not a guarantee, she said, she privately and personally doesn't think there is any risk.
Lawsuit fee:
1) if you go with a lawyer. The lawyer charges around $3000 up to $3500. Before it goes to the court, the case needs a council member in your local district onto board who takes care of the local federal court. This is another around $1000. Also you need to pay the $350 filing fee. So in total it's around $5000.
2) I double checked with the friendly lawyer. She said I could do it by myself because such case is simple as just some simple document and very unlikely it will go to the court because FBI almost always chooses to withdraw the case. In this case, $350 is the only fee to pay.
So anybody has a template? We can google to get some template document or ask somebody who is a paralegal that knows how to do it.
