I am currently working for a company with h1b visa (my h1b visa will expire in Dec. 2007). I recently got a job offer of tenure-track assistant professor position at a university and the starting date is 8/13/2007. I will ask the help of the university to do a h1b transfer for me. Since my starting date 8/13/2007 is Monday, if I resigned from my company at 8/10/2007 which is the last Friday before 8/13, will I be considered out of status during 8/11 and 8/12 which are the two weekend days? If the answer is yes, do you think it is legally to resign on 8/12 which is Sunday? If the answer is no, that is good, but why?
