My parents' situation:
- B2 visa is valid until 01/21/08.
- entered the U.S. on 03/29/07 and got 6-months stay. So their I-94 is valid until 9/29/07.
- filed I-539 in 8/18/07 and the case was denied on 10/6/07.
Q1: Their original visa is valid until 01/08. So if they go back to China now due to the denial of the I539, is their visa still valid?
Q2. Can they still use that visa to enter the U.S. before 01/08?
Q3: I heard that their visa got canceled automatically when I filed I539 for them. Is it true?
Q4: If I decide to file a motion to reconsider the case, is it legal for my parents to stay between now and the new decision is made?
