I'm currently on EAD and planning to open up an S-corp. I've searched on the net, some ppl said S-corp can only be opened by citizen/gc holder. But reading through reg_7701b_1-9, it seems that I've passed the substantial presence test and I shall be considered as resident alien for tax purpose. So, that means I also passed all 8 tests in i2553, and I shall be able to elect S-corp. Can someone pls give me some insight on this one? Thanks so much.
