More question: my new employer wants me to start job ASAP, but becuase I have done with my 6yrs H1b, lawyer worries that my employer may revoke my approved 140. so, they suggested me to stay with old employer until the H1b transfer is approved. but since I need to give current employer 2 week notice, it will be too long after I get the approval. Background for my 140 is: my 140 is from company C, and our department is spinned off from company C to company A which is my current employer, they had filed a 140 transfer and haven't received the receipt yet, and they haven't file h1b transfer for me which means my h1b sponsor is still company C. So, my questiones are:
1. in this case, does company A have right to revoke my 140? And because,I am not employed by company C, company C is not likely do revoke from my 140. is my understanding correct?
2.Also, the h1b is from company C, and my recent paystub is from company A,will this cause problem for H1b transfer?
3. Also, in case that my spouse is laid off by company, can this trigger 485 ref? We sumbitted 485 on July 2007, and because this is Eb3 case, it should be long waitting time to be current. So, as long as no ref, the EAD is safe for me in case that my H1B transfer is rejected and I have to use EAD. Thanks.
