My H1B expires in early 2014. HR is asking for the status of my hu*****and's green card status. His EB2 priority date is in 2011. I have been with my company since 2006. They have previously started the process for me, but was unable to proceed due to the number of applications received after the position was posted. They refused to include higher requirements such as master's degree and industry certification. I have several questions I was hoping you guys could help with:

1. Is there any chance that my hu*****and's priority date could become current early enough to help me? I know the chance is very remote.

2. Is it legal for my employer to ask about the green card status of my hu*****and? Should we have our privacy in that regard?

3. How should I respond to HR? Should I just say that his application will be submitted once his date becomes current without giving out the specific date?

4. If other people currently in my position do not all have master's degree, can my employer not post my position requiring a master's degree?
