It seems USCIS is just statting to pull out cases delayed by NC.
If NC has been pending over 3 years, they will approve directly. But for those delayed by NC between 6 months and 2 years, they will communicate with FBI again, and then decide to approve or not. If they do not approve, they will sedn you a notice that youe case need additional review.
It will also depends how the visa bulletin and processing date will go in the comming months.
Anyway, It seems that we will have to wait.
March 10th, April 30th, 6 months and waitting for FBI NC feedback, that is what USCIS told me in the past days after memo came out. Everything is not certain except one thing, that is: you have to keep waitting with or without hope.
Mail, Fax, call all do not work, the best way maybe is just wait for another 2 or 3 months, and if no update, just file WOM. Standing up bravely and resolutely for yourself, that is the only efficeint way to overcome and solve problems.
My case is not delayed very long, but I am felling good. The memo came out on Feb 04th, one month passed, how many people really get their green cards based on the memo? For those who have been stcuked by name check for many years and still are played by USCIS, the memo will work, but might not work efficiently if you do not make your voice heard.
So, wait with hope, and prepare to file WOM. The memo provides us a base to win. Be strong and be ready to fight!
If the visa bulletin and processing date retreat quite big this month, that is the sign that USCIS is begining another game with you (it shows you a bread but it is not for you to eat), and that is the momet you should stand out and fight for you, fight for your family and fight for next gerneration!
