Today I just went an infopass and met a nice person and got some new info and shared with you and hope will help.

Q1. My PD was 2002 and RD over 30 days than TSC processing time and NC >500 days, my case meet all requirements that USCIS mentioned on the memo issued in Feb 2008,what's the problem that my case still pending?

A: (1) the NC is the key point. Althought there has a memo, not everyone follow the memo in services center. If your NC not clear, your case still not be reviewed..(2) The Processing time means that your case "might be reviewed", but not means that your case be "approved". How deep or how much USCIS would review on your case, no one knows... (3) Since your file the I-485, PD was not a key point, the service center concern the RD than PD. PD only would be a key point when they issued you the GC..(4) Each officer in the service center has his "quantity" requirement to finish the number of the case on particular period. So some of the officers will choose the easy cases to do first and hold the other cases in order to meet the requirement.

Q2. My 1st FP would be expired and when should I receive my 2nd FP?
A: You would be notified the 2nd FP when someone started to touch or review your case and find out that your FP was expired. It is "manually" notice not "automatically" identified by the system.... So, normally your case would be notified the 2nd FP when they started to take care your case and might be approved.

Q3. But my friend still got 2nd FP when his PD was not current..
A: There might be someone just check his I-140 or other Info and figured out that his FP was expired and gave him a notice, this kind of notice did not mean anything... As I said, it is manually not automatically.

Q4: Can I verify the data input into the USCIS system was correct?
A: He only can see the nationality, type of immigration, RD date.. His screen can not tell EB 1, EB2.. or EB3. The important thing is, on his data he can not see the PD... So, it approves that PD was not important as RD since you filed I-485.

Q5.If I did not receive the 2nd notice after 18 months, what should I do?
A: FP still keep 15 months but as I said that your FP would be a issue when someone open your case. So you only can wait.

Q6. If I have to reschedule the FP, what should I do?
A: You have kept all your doc to approve that your reschedule is needed. Copy and keep all the docs you have and call and then follow the instruction that USCIS require. But the really reschedule was made by ASC.

Q7. I just renew the EAD and got the 2 years EAD, did it mean that my case would be process 2 years long?
A: EAD starts 2 years just because the new policy, not related to your I-485 process.

Q8. When should I to do another follow up on my case if I still not receive any info from USCIS?
A: You should wait at least 2 months to do another SR or Infopass to let the USCIS to process your case. By the way, since you know your problem is NC, it is better do the Infopass first to let the IO in the Infopass to do the internal request for you. It would be better than call 1-800 number to do the SR.

Q9. How can I know if my case has been assigned to an officer review or still waiting to be assigned?
A: First, since your case received and input to the system, your case has been assigned to an officer and how long the officer to review would be a judgment call. Some officer would take more time to review and hold your case. The respond on the SR is just standard wording unless you receive any specific answer.

Q10. My H1b 7-9 years would be expired next year, what should I do to keep my status. Still file 3 years H1b or only can file 1 year H1b?
A: You have EAD, use EAD. (He did not answer my H1b question since he knows that I apply EAD)
